Benesch’s Transportation & Logistics Group was specifically created to address the needs of users and providers of transportation and logistics services. This nationally preeminent, multidisciplinary group of transactional, regulatory, and litigation attorneys, services clients nationally and internationally. We have 20 attorneys in this practice group, including seven who were previously in-house in the transportation industry (several at motor carriers, one at international freight forwarders and one at an international maritime steamship line). We have significant experience in transportation and logistics management, in all transportation modes, on a regional, national and global basis. As a result, we are also able to provide valuable industry perspectives and a deep and broad historical knowledge of the regulatory and legal regime. Our firm has specific expertise in supply chain, logistics management and warehousing related issues, cargo claims, vehicular casualty work, environmental claims, coverage disputes, freight charge disputes, freight intermediary issues, transportation and warehouse contracting, regulatory matters, acquisitions, restructuring and subrogation work.
Broad Based Representation Throughout the Supply Chain

Benesch is one of the few law firms in the country that not only has a full service Transportation & Logistics Group, but also represents entities all along the transportation continuum. More specifically, we represent motor carriers, air carriers, rail carriers and maritime carriers. However, we also represent a broad array of “freight intermediaries”, e.g. transportation brokers, surface freight forwarders, air freight forwarders, NVOCC's and OTI's. We also represent warehousing entities up and down the transportation chain and numerous shippers, and consignees. This broad based expertise, and intricate and intensive working knowledge of all aspects, and all entities, in the transportation continuum, places Benesch in a unique position to extraordinarily serve its clients in this field.

Unique Transportation Expertise Coupled with a Full Service Law Firm

Because we practice across so many modes, and handle such a diverse array of substantive matters for those clients, over the years we have involved many other attorneys at our firm in transportation and logistics related matters. Those attorneys have specific extant expertise in substantive areas such as corporate and securities, labor and employment, and ERISA, yet because of our focused and extensive expertise in transportation and logistics, they have been exposed to the industry, its regulatory regimen and its legal aspects. Commensurately, we are one of the only firms in the country to have the breadth and depth of expertise in the transportation and logistics space, coupled with the bench strength of a full service law firm. This confluence of industry specific, and broad and deep general business expertise, is truly unique, and serves our transportation and logistics clients in unparalleled fashion.

Transportation & Logistics Contractual Experience

We also have specific experience in all types of contracts up and down the transportation continuum. We regularly assist our clients with the drafting, negotiation and revision of shipper-carrier contracts, broker-carrier contracts, broker-shipper contracts, warehouseman contracts, cross-docking arrangements, drayage contracts, port-terminal operational contracts, global services agreements and the plethora of transportation contracts in the industry.

Regulatory Compliance

Benesch's attorneys have experience with the regulations that directly effect how transportation entities run their businesses. We can proactively assist our clients in developing compliance programs as well as responding to compliance issues if they should occur. We can also help our clients through the maze of transportation and other governmental regulations through our understanding of the underlying objectives of the regulatory structure, and have experience in proceedings before the STB. We also assist our shipper, freight intermediary, and carrier clients with carrier selection protocols to minimize exposure for catastrophic losses.

Maritime Capabilities

The Benesch Transportation & Logistics Group has represented numerous maritime and related entities in connection with domestic and international maritime and NVOCC operations. Benesch attorneys have the knowledge and experience required to handle litigation, acquisition and divestitures needs, along with advising companies on becoming operational as NVOCC's. We have experience in dealing with maritime bills of lading, cargo loss, warehousing, insurance subrogation, and maritime accident related litigation and arbitration cases.
